Finca Malata rents rooms exclusively for recreational purposes..

These general terms and conditions apply to all guests of Finca Malata

Article 1: General

  1. Guests must have a permanent place of residence, be at least 21 years or older and have a valid ID. Valid ID is required upon check-in. The rates for the rooms are listed on www.fincamalat.com.The rates of Finca Malata include water, electricity, WiFi, VAT, bed linen, towels and 1 extra bath towel per person for the pool. Excluding tourist tax, this is determined annually.
  2. Breakfast is a choice for both rooms, as are all other meals, drinks and certain facilities offered for which an additional charge applies. Additional costs apply for charging an electric plug-in car
  3. Finca Malata is unfortunately not suitable for children and people in wheelchairs
  4. Our rooms are suitable for a maximum occupancy of 2 person each room.
  5. We grant our guests a carefree stay, real, all risks associated with a stay at Finca Malata are borne by the guests: We cannot be held liable for personal injury, damage, loss, theft, accidents, medical costs and/or damage to goods caused by personal inattention or by circumstances beyond our control.
  6. If the keys to Finca Malata are lost, all resulting costs will be charged to the guests. 
  7. Naturally, we expect our guests to report any damage and/or missing items to us. Any resulting costs will be charged.
  8. Finca Malata is not liable for disruptions in and around the accommodation, such as power outages, WiFi, water supplies and technical installations.
  9. We expect our guests to follow instructions from the owner
  10. Guests must use the facilities of Finca Malata with care and take other guests and local residents into account.
  11. Finca Malata can, in the event of a violation of these General Terms and Conditions and/or in case of inappropriate behavior, deny and/or refuse access to guests with immediate effect, without further notice and giving reasons and without refunding the accommodation costs.
  12. The owner’s administration is decisive in the event of a mutual disagreement unless the guest can prove the contrary.
  13. Finca Malata will treat all personal data provided or made known to it strictly confidential..

Article 2: Reservation and payment 

  1. The reservation request can be made by telephone, e-mail, WhatsApp or via our website..
  2. After receiving a reservation request, Finca Malata will send a confirmation by e-mail.
  3. The reservation is final after receipt of payment. this will be confirmed by email
  4. It is not allowed to rent a room in your name without staying there yourself.

Article 3: Cancellation

  1. In case of cancellation of the reservation, the following conditions apply:
    • If you cancel 2 weeks or earlier before the arrival date – no cancellation fees
    • If you cancel from 14 days to 6 days before the arrival date – 50% cancellation costs
    • If you cancel 5 days or less before the arrival date – 100% cancellation fee
  2. The cancellation conditions can only be deviated from at the discretion of Finca Malata (for example int the event of emergencies)
  3. To be eligible for any refund, the cancellation must be communicated directly by email: info@fincamalata.com
  4. After consultation, the agreed amount will be transferred within two weeks.
  5. Refunds will be made by transferring the amount to the bank account number from which we received the payment. Exceptions to this are not possible.
  6. No refund will be made in the event of early departure.
  7. We recommend taking out travel and/or cancellation insurance..

Article 4: Arrival and departure

  1. On the day of arrival, the room is available from 15.00h and check-in is possible until 18.00h. It would be appreciated if we received the expected arrival time in advance via WhatsApp, for example.
  2. Deviating arrival times than above are only possible in consultation.
  3. Due to the cleaning of the rooms, it is necessary to vacate them before 12.00h on the day of departure.
  4. A later check-out is possible upon consultation if the room is available, at an additional cost of €20.

Article 5: Smoking and pets

  1. Bringing pets is allowed as long this is discussed with us in advance.
  2. Smoking is NOT allowed in the rooms of Finca Malata. If you still want to smoke, you can do so outside on the private terrace.

Article 6: Parking

  1. Cars and motorcycles can be parked for FREE on the closed plot, which is equipped with video surveillance..

Article 7: Complaints

  1. Naturally, we do our utmost to offer our guests a carefree and unforgettable stay. If, despite our good care, there is a complaint, we would like to hear it on the spot so that we can resolve it immediately.

Article 8: Information

  1. We have done our utmost to describe the rooms, their location, the surroundings and the activities in the area as accurately and completely as possible on the website, without, however, accepting any liability for the accuracy.
  2. We have the right to change the published information, including prices, photos and descriptions at any time.
  3. We have the right to adjust the General Terms and Conditions when necessary.
  4. Guests are deemed to have taken note of the contents of these General Terms and Conditions and to agree with them. In any case, the guest has expressly agreed to the contents of these General Terms and Conditions when placing a booking.

Article 9: Termination of agreement

  1. In the event of force majeure, both permanent and temporary, Finca Malata is entitled to partially or completely dissolve or temporarily suspend the agreement without the guest being able to claim performance and/or compensation. Force majeure includes, but is not limited to: danger of war, war, rebellion, molestation, strikes, boycott, major disruptions in the energy circuit, government measures, natural disasters, fire, scarcity of raw materials, death of one of the owners or close family members, etc. under which full or partial compliance with the agreement cannot reasonably and fairly be expected from Finca Malata. If no alternative is possible or the guest does not accept the alternative offered, the full amount will be refunded. Any other costs resulting from the cancellation will not be reimbursed by the owner.

Article 10: Applicable law

  1. Spanish law applies to the rental agreement and all obligations arising from it and the court in Valencia has jurisdiction to hear any disputes.
